Terms of Service
By accessing or using the 3D modeling services provided by Aerial Arborist Innovations, LLC ("we," "us," or "our"), or any third-party products or services integrated into our applications, you agree to be bound by the following terms:
1. Assumption of Risk and Disclaimer of Accuracy
Pruning, removing, and any other related work on trees can result in property damage, serious injury, and/or death. The 3D models we provide are for informational and planning purposes only and are not a substitute for on-site, physical inspection. You acknowledge that the actual tree and its surroundings may differ significantly from the 3D model. By using our services, you agree that anyone utilizing our models must use their own professional judgment and expertise to determine the usefulness, accuracy, and safety of the content provided. You are solely responsible for your decisions, actions, and any resulting consequences.
2. Legal Compliance and Aerial Capture
You represent and warrant that any video or imagery you submit was captured legally. If you utilized an Unmanned Aircraft System (drone) to capture the content, you warrant that you complied with all applicable local, state, and federal aviation regulations (such as FAA guidelines), and that you did not trespass on private property or violate any airspace restrictions to obtain the footage.
3. Privacy and Acceptable Use
When you submit a video to us, the resulting 3D model will be made publicly available on the internet. It is your sole responsibility to ensure that the content you submit does not violate anyone's reasonable expectation of privacy, nor contain any unlawful, illicit, or copyrighted material. Aerial Arborist Innovations, LLC reserves the right, at its sole discretion and without refund, to reject or remove any content that we determine violates privacy rights, violates local, national, or international laws, or is inappropriate, illicit, or pornographic in nature.
4. Ownership and Licensing
You retain ownership of the original video and image files you submit. However, by submitting content to us, you grant Aerial Arborist Innovations, LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and modify the submitted content to create 3D models, and to publish those resulting models online. You also grant us the right to use your submitted content to train and improve our services, which may involve sharing the content with authorized third-party vendors. Aerial Arborist Innovations, LLC retains all ownership rights to the final 3D models generated by our service.
5. Public Access and Sharing
While each published 3D model is assigned a unique web address, these addresses are publicly accessible. You are solely responsible for whom you share these links with. Aerial Arborist Innovations, LLC is not responsible for tracking or controlling who views, downloads, or adds measurements, comments, or other annotations to your 3D models.
6. Indemnification
You agree to indemnify, defend, and hold harmless Aerial Arborist Innovations, LLC, its officers, employees, and partners from any and all claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from or related to the content you submit, your use of the services, or your violation of any third-party rights, including privacy and intellectual property rights.
7. Warranty Disclaimer and Limitation of Liability
Our services and models are provided on an "AS-IS" and "AS-AVAILABLE" basis, with all faults, and without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, Aerial Arborist Innovations, LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, our services. In no event shall our total liability to you exceed the amount you paid for the specific service in dispute.
